Overview
Module aims and purpose
- To introduce the fundamental concepts of EquityÌý
- To examine the main principles of Express, Resulting and Constructive Trusts, and Purpose Trusts.Ìý
- To critically evaluate the law of equity and apply it to problem scenarios.ÌýÌý
Module learning outcomes
By the end of the module, it is expected that students will be able to:Ìý
- Describe the main principles of equityÌý
- Demonstrate an understanding of the main principles governing different types of trustsÌý
- Apply the above principles to fact situations, citing relevant material in support.Ìý
- Undertake independent legal researchÌý
- Critically evaluate and put forward own view while formulating recommendations and presenting arguments.ÌýÌýÌý
This module will encourage the development of oral communication skills in the student's contribution to group discussion.ÌýÌý
Module content
The course will cover the following main areas of study:Ìý
- The principles and doctrines of equity, including equitable remediesÌý
- Express Private Trusts;Ìý
- Administration of Trusts;Ìý
- Resulting and Constructive Trusts;Ìý
- Purpose Trusts.Ìý
Structure
Teaching and learning methods
Combination of lectures, workshops, tutorials and blended activities.
Lectures (whole cohort): two hours of lectures per week for 11 weeks.
Workshops: one two-hour session per fortnight starting either in w1 or w2 and excluding the mid-semester week. Active learning with some material provided.
Tutorials: one one-hour session per fortnight in the week following the workshops.
Blended activity (whole cohort): guest lecture, pre-recorded video etc.
Study hours
At least 37 hours of scheduled teaching and learning activities will be delivered in person, with the remaining hours for scheduled and self-scheduled teaching and learning activities delivered either in person or online. You will receive further details about how these hours will be delivered before the start of the module.
